Terms of Service — Ludi Apps & ludicloud Services

By downloading, installing or using a Ludi app and/or the ludicloud services, you agree to these terms.

Please read them carefully.

1. Parties

These terms apply between you ("the user") and [Placeholder] (Ludi / ludicloud.com, e-mail:

[email protected]), the provider of the Ludi software and ludicloud services.

2. The Service

The Ludi apps (available for Windows, Linux, Android and Samsung TV) are media applications that let you

play and organise IPTV content that you manage yourself. The ludicloud services provide, among other

things, account management and an optional cloud synchronisation of profiles, watch progress and favourites.

3. Responsibility for content and provider

The user is solely responsible for the IPTV content, the IPTV provider and the sources used through the app.
The user represents and warrants that he or she holds all necessary rights, permissions and licences for

the content that he or she plays or makes accessible, and that such content does not violate the law or

the rights of third parties.

Ludi does not provide content and is not an IPTV provider. Ludi is not liable for the nature, lawfulness

or availability of content or providers used by the user.

Provider login details are stored only locally on the user's device and are never sent to the

ludicloud.com servers.

4. Account

Certain features (such as cloud synchronisation) require an account.
The user is responsible for keeping his or her login details (e-mail address and password) confidential

and for all activity taking place through the account.

The user must notify Ludi immediately of any unauthorised use of his or her account at

5. No warranty of uninterrupted service

Ludi provides the apps and ludicloud services to the best of its ability, but does not warrant an

uninterrupted, error-free or indefinitely available service.

The availability of content depends on external providers and internet connections over which Ludi has

no control.

Ludi may (temporarily) modify, interrupt or terminate the service, for example for maintenance or

improvements, without giving rise to any claim for compensation.

6. Limitation of liability

To the extent permitted by law, Ludi is not liable for indirect, incidental, consequential or special

damages, including loss of profit or loss of data.

The total liability of Ludi for direct damages is limited to the amount the user has paid for the

relevant service in the twelve months preceding the event giving rise to the damage or — if no payment

was made — to a maximum of € 100.

Nothing in these terms limits liability that cannot be excluded or limited under mandatory law.
The app is provided "as is". Unless otherwise stated, use is at the user's own risk.

7. Termination

The user may stop using the service at any time by uninstalling the app and/or deleting his or her account.
Ludi may suspend or terminate a user's account or access if the user breaches these terms, violates the

law, or where this is necessary for the security of the service.

Upon termination or deletion of the account, the associated data is removed in accordance with the

Ludi may change these terms from time to time, for example upon changes to the service or the law.
The most recent version is always available on our website. In the event of significant changes, we will

notify users in a timely manner.

If the user continues to use the service after the effective date of a change, he or she is deemed to

accept the amended terms.

9. Governing law

These terms and the use of the service are governed exclusively by Dutch law. Disputes shall be submitted

to the competent court in the Netherlands, without prejudice to mandatory provisions in favour of the

consumer in his or her country of residence.
